JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 16-01-2015 Heard learned counsel for the petitioners and learned counsel representing the State.

The petitioners, apprehending their arrest in connection with Siswan P.S. Case No. 189 of 2013 registered for the offences punishable under Sections 406, 420, 465, 467, 468 and 120B of the Indian Penal Code, seek the privilege of pre-arrest bail. Allegedly, the petitioners under conspiracy demanded Rs. 3,60,000/- from the complainant for providing job in Purbanchal Agriculture Marketing Nigam Ltd.

and the complainant being in need of service gave Rs. 2,00,000/- cash and 1,60,000/- after keeping the land mortgaged in presence of Aditya Kumar Yadav on 30.04.2012 and after two days, they assured to give joining letter and allegedly a forged joining letter was given

Patna High Court Cr.Misc. No.29996 of 2014 (2) dt.16-01-2015 and the complainant joined but after 3-4 days, the office was closed and then the complainant thought that he had been cheated. Submission is of false implication and further that Aditya Kumar Yadav instigated the complainant to implicate the petitioner and at his instance the petitioners have been implicated and he is lodging one case after another. The petitioners have been allowed pre-arrest bail vide order dated 19.03.2014, vide Cr. Misc. 1905/2014 in other case to which the learned A.P.P. opposes the prayer for pre-arrest bail.

As the complainant/informant entered into an illegal agreement with petitioners and thereafter they have been cheated and as such petitioners namely Sonu Yadav @ Sonu Kumar Yadav and Prabhunath Yadav, in case of their arrest or surrender within two months from the date of receipt/production of the copy of this order, shall be released on bail on execution of bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate., Siwan in connection with Siswan P.S. Case No. 189 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.
