Mr. KHURSHID ANWAR ====================================================== CORAM: HONOURABLE DR. JUSTICE RAVI RANJAN ORAL ORDER 09-11-2017 I have heard learned counsel for the petitioner and the State.

The petitioner seeks bail in a case registered for offences punishable under sections 272, 273, 413 and 414 of the Indian Penal Code, section 30 (a) of the Bihar Prohibition and Excise Act, 2016 and sections 25(1-b)a, 26 and 35 of the Arms Act.

It is contended that, as per allegation, 43 litres 250 Ml. of foreign liquor was recovered from the room of the petitioner. It is further contended that no firearm has been recovered from the possession of the petitioner rather the same has been recovered from possession of co-accused Raja @ Prince. Petitioner claims that he is having clean antecedent and is in custody since 15.8.2017.

No.51722 of 2017(2) dt.09-11-2017 2/2 Having regard to the facts and circumstances of the case, the above named petitioner is directed to be released on bail on his furnishing bail bond of Rs. 10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise Act, Purnea, in connection with K.Hat P.S. Case No. 568 of 2017 giving rise to Special Excise Case No. 2193 of 2017.

If the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds.
