Anita Kumari Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 12-03-2019 Heard the learned counsel for the petitioners and the learned counsel for the State.

The petitioners seek regular bail in connection with Rajnagar PS case no. 350 of 2018 registered for the offence punishable under Sections 341, 324, 307, 506/34 of Indian Penal Code.

The allegation is regarding the petitioners herein having assaulted the members of the informant side as also the informant. Although the petitioner no. 1 is said to be the brother of the informant and the petitioner no. 2 is said to be the nephew of the informant, the altercation has taken place on account of certain family disputes and a free fight had ensued thereupon

The learned counsel for the petitioners submits that though the injuries received by some persons of the prosecution side may be grievous in nature but the accused persons have also received injuries. It is further submitted that the petitioners are languishing in custody since 24.10.2018 though they are having clean antecedent. It is further submitted that the petitioners are ready to abide by whatever conditions as is deemed fit and proper to be imposed by the Court of law for the purposes of grant of bail and maintaining peace. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioners on regular bail.

Accordingly, the abovenamed petitioners are directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st, Madhubani in connection with Rajnagar PS case no. 350 of 2018. It is further directed that the petitioners shall mark their attendance before the officer-in-charge of the concerned police station at 10.30 am on every Monday and in case of failure to do
