JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-07-2015 Heard learned counsels for the petitioner and the State. The petitioners being the married sisters and the brother-in-law of the husband of the victim are apprehending arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.
The prosecution case is that the informant's sister was married with one Sanjay Mistry in the year 2002 and out of wedlock two children were borne, subsequently the brother-in-law of the informant became mentally ill and thereafter the victim was tortured by the in-laws family members. Subsequently on 19.01.2015 the informant came to know about the death of his sister by burnt injury.

No.23169 of 2015 (2) dt.07-07-2015 2/2 It is submitted by learned counsel for the petitioners that the informant is not the eye-witness to the occurrence and the petitioners are resident at a different place. Considering the fact the accusation is omnibus and general, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Saharsa in connection with Saharsa P.S. Case No. 39 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
