The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 147, 148, 149, 153(A), 154(A), 153(B), 295(A), 341, 323, 353, 327, 379, 427, 435, 504 and 506 of the Indian Penal Code and Sections 3/4 of the Damage of Public Property Ac, 1984. According to the FIR, a mob of 25 persons were attempting to create communal disharmony and they obstructed in discharge of official duty of the public servant and they allegedly damaged the public property.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that there is general and omnibus allegation

Patna High Court CR. MISC. No.16571 of 2022(2) dt.15-09-2022 2/2 against the petitioner and similarly situated co-accused persons have already been granted bail vide Annexure-2 series. Petitioner has clean antecedent.

Learned APP appearing for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid submissions, let the petitioner, above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Saharsa in connection with Sour Bazar (Baijnathpur) P.S. Case No. 176 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
