The petitioner has preferred this application for grant of regular bail in a case registered under sections 392 and 120B of the Indian Penal Code.

As per the prosecution case, accused persons on motorcycle on the point of pistol took away the bag containing the cash from possession of the informant. The informant raises suspicion on the petitioner who also worked in the same shop and was regularly asking the informant about the quantity of sale and the body of the pistol which had been shown by the petitioner on his mobile phone was exactly the same which was used in connection with the crime.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case for

Patna High Court CR. MISC. No.26844 of 2021(3) dt.22-11-2021 2/2 oblique reason. No incriminating material has transpired in course of investigation. The allegation of recovery of stolen motorcycle on the basis of confession of the petitioner is false and concocted. No amount/money has been recovered from possession of the petitioner. The petitioner has no criminal antecedent and is in custody since 20.1.2021. Chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the period in custody and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Dehri (Town) P.S. Case no.52 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist, Dehri-on-Sone, Rohtas.
