The petitioners have filed the instant application for grant of regular bail in connection with Samastipur Mufassil P.S. Case no. 177 of 2019 registered under sections 302, 307, 323, 341 and 34 of the Indian Penal Code.

As per allegation in the F.I.R., mother-in-law of the informant was assaulted by the petitioners leading to her death. It is submitted by learned counsel for the petitioners that the allegations against the petitioners are false and concocted. The mother-in-law of the informant died in a manner other than what has been narrated in the F.I.R.

Patna High Court CR. MISC. No.14476 of 2020(3) dt.09-02-2021 2/2 Petitioner no.2 is a lady. The petitioners have no criminal antecedent and are in custody since 23.12.2019 i.e over 1 year. Charge sheet has been submitted in the case.

The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the period in custody, this Court is inclined to enlarge the petitioners on bail. The petitioners are directed to be enlarged on bail in connection with Samastipur Mufassil P.S. Case no. 177 of 2019 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.- 5th , Samastipur.
