The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 354(B), 307, 379, 504, 506/34 of the Indian Penal Code.

It is a case of assaulting, outraging the modesty of the daughter-in-law of the informant and taking away Rs. 1,50,000/- and ornaments from the house of the informant.

It is submitted by learned counsel for the petitioner that two days prior to lodging of the present case, wife of the petitioner has registered Matiyaria P.S.

Patna High Court CR. MISC. No.16511 of 2022(2) dt.12-09-2022 2/2 Case No. 100 of 2021 against the informant's side, hence, as a retaliatory measure, this false case has been registered. There is no injury report on the record. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, IVth, Bettiah, West Champaran in connection with Matiyaria P.S. Case No. 101 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
