1. Heard learned counsel for the petitioners and learned A.P.P. for the State Mr. Rajendra Singh.
2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 363, 366(A) and 34 of the Indian Penal Code.
3. Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and have been falsely implicated in the instant case being relative of Golu with whom the victim was in love. It is next submitted that the
Patna High Court CR. MISC. No.18249 of 2024(2) dt.01-04-2024 2/3 informant alleges that on 15.11.2023 his grand daughter aged about 15 years 11 months had gone to Panchdeori when Golu kidnapped her for wrong intention, accordingly, the informant went to the house of Golu but his family members did not pay any heed. The learned counsel next submits that petitioners are uncle (Mausa), Mausi and maternal sisters of Golu. It is also submitted that from perusal of the allegation, it would manifest that the entire allegation hinges around suspicion. It is next submitted that whenever any dispute of the nature as alleged takes place, the entire family members are implicated. It is also submitted that the victim has come back and has not supported the case of the prosecution nor has raised any allegation against the petitioners.
4. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
5. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned trial court where the
