Having regard to the nature of allegation against the petitioner for the offences punishable under Sections-406, 409, 420 and 34 of the Indian Penal Code and the petitioner being jointly liable with the headmaster in the embezzlement of the public fund, this Court is not inclined to grant anticipatory bail to her. As a matter of fact, this Court from the order of the Sessions Judge would also find that the amount of Rs. 13,500, Rs. 52,020 and Rs, 40,000/- allegedly embezzled was withdrawn with the signature of the petitioner and therefore, she also becomes equally accountable for the aforementioned public money. That being so, the prayer for anticipatory bail of
Patna High Court Cr.Misc. No.30283 of 2014 (2) dt.14-01-2015 the petitioner is hereby rejected.
Nothing said in this order, however, would weigh against the petitioner in surrendering before the Court below and praying for regular bail.
