Petitioner apprehends arrest in connection with Pratapganj P.S. case No.22 of 2015 for offences alleged under Sections 420, 467, 468, 471 and 120B of the Indian Penal Code. The prosecution case, as lodged by the informant, is that the petitioner for appointment as Assistant Teacher had applied in Gram Panchayat, Bhawanipur North on the basis of forged T.E.T. certificate.

It has been submitted by the learned counsel for the petitioner that the petitioner had only applied did not appear for the test and neither he was appointed as an Assistant Teacher in the said Gram Panchayat. It has further been submitted that the

Patna High Court Cr.Misc. No.17931 of 2016 (2) dt.05-05-2016 2/2 petitioner has clean antecedent as is evident from paragraph 3 of this application and a similar co-accused has since been granted the privilege of anticipatory bail in Cr.Misc.No.50416 of 2015 on 10.11.2015.

However, learned APP for the State submits that the petitioner is named in the First Information Report, hence opposes the prayer for bail.

Be that as it may, since on similar allegations, co-accused has already been granted the privilege of anticipatory bail, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of eight weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Birpur (Supaul) in connection with Pratapganj P.S. case No.22 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
