The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act.

As per the prosecution case, 1051.385 litres of IMFL was recovered from a hut situated in the land of one Chandra Shekhar Singh.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the petitioner's possession. His name transpired in the statement of a co-accused. The seized liquor was stated to belong to the petitioner. The petitioner is in custody since 11.1.2021 and has been falsely implicated because of his antecedent.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for more than 10 months, the Court directs the petitioner to be enlarged on bail in connection with Vaishali P.S. Case no.185 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cum-Special Judge, Excise Court, Vaishali.
