2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 467, 468 , 471 and 420 of the Indian Penal Code.
3. As per the prosecution case , this petitioner along with other co-accused persons prepared several fabricated documents with intention to grab the land of informant.
4. It is submitted on behalf of the petitioner that no forged documents has been prepared by this petitioner and he has falsely been implicated in this case . From bare perusal of the FIR, it is apparent that the dispute is purely of civil nature .
Patna High Court CR. MISC. No.18822 of 2024(3) dt.19-04-2024 2/2 Title suit No. 319 of 2023 is going on between the parties. Similarly situated co-accused persons have already granted bail by this Court vide order dated 82824 in Cr. Misc. No. 82824 of 2023 . Petitioner claims clean antecedent.
5. Learned counsel for the State opposes the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM Sasaram, Rohtas in connection with Sasaram (M) P.S. case No. 288 of 2023 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
