Petitioner seeks bail in Kurhani P.S. Case No.362 of 2016 instituted for the offence under Section(s) 399, 402, 414 Indian Penal Code, Sections 25(1-b)a, 26(ii) and 35 of the Arms Act and Sections 8/20 (b) (ii)(B) of the NDPS Act. Counsel for the petitioner has submitted that prayer for bail of this petitioner was earlier rejected by this Court along with co-accused, Rakesh Kumar @ Navin @ Golu, by order dated 27.07.2017 passed in Cr. Misc.No.24180 of 2017. Aforesaid co-accused, Rakesh Kumar @ Navin @ Golu, has been granted bail by this Court by order dated 02.05.2018 passed in Cr. Misc. No.16213 of 2018.

It has further been submitted that one country made

Patna High Court Cr.Misc. No.35902 of 2018 (2) dt.27-06-2018 2/2 pistol and three live cartridges was recovered from the possession of this petitioner. The petitioner has moved for bail before the Court below, but the Court below has mentioned in the impugned order that Charge against the petitioner and others have been framed on 12.12.2017 and the case is fixed for evidence. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of `10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge-cum-Special Judge, Muzaffarpur, in connection with Kurhani P.S. Case No.362 of 2016, subject to the condition that both the bailors shall be close relative of the petitioner.

The petitioner in any manner will not try to hamper the trial by intimidating or influencing the witnesses and will remain present on each and every date of trial. Absence of the petitioner on two consecutive date(s) without any reasonable cause will make the bail bond of the petitioner liable to be cancelled.
