The petitioners apprehend their arrest in Chhatpur P.S. Case No. 210 of 2020 registered for the offences punishable under Section 307 and other allied sections of the Indian Penal
Patna High Court CR. MISC. No.17352 of 2022(2) dt.29-08-2022 2/2 Code.
As per the FIR, on the alleged date and time of occurrence, petitioners armed with weapons forcibly cutting bamboo from the field of the informant and when the same was objected by the informant, all the accused persons assaulted as a result of which two persons sustained injuries. It is submitted that there is case and counter case between the parties. Both sides sustained injuries. Injuries sustained by the injured is simple in nature. Petitioner nos. 1, 3, 5 and 11 have got no criminal antecedents.
Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Supaul in connection with Chhatapur P.S. Case No. 210 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
