Petitioner is apprehending his arrest in a case registered under section 498 A of the Indian Penal Code. There is allegation of demand of dowry and torture for the same after solemnization of the marriage in the year 2010.

It has been submitted on behalf of the petitioner that petitioner has no criminal antecedent. It is further submitted that petiotner has been falsely implicated by the complainant. The said fact is evident from annexure-2 to the present application

Patna High Court Cr.Misc. No.24261 of 2015 (3) dt.03-09-2015 2/2 where this very complainant has instituted a case against one Aklhilesh Mahto as back as in the year 2007 and the present case is a second complaint which has been instituted against this petitioner. The petitioner denies that the complainant is his wife. On behalf of the State and the counsel for the complainant it is submitted that the petitioner is named in the complaint.

Considering the aforesaid facts and circumstances, the above named petitioner in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in Complaint Case No. 1962 of 2014, subject to the conditions as laid down under section 438 (2) Cr.P.C.
