Petitioner apprehends his arrest in connection with Nawanagar P. S. case no. 52/2015 registered under sections 406, 409 and 420 of the Indian Penal Code.
Petitioner happens to be rice miller and accusation against him is that he did not supply rice as per agreement executed between the parties but admittedly, one of the clauses of the agreement says that in failure of supply of rice, Corporation may initiate certificate case and in the present case, Corporation has already instituted certificate case.
Furthermore, it is informed that several cases were instituted against different persons and this court as well as coordinate benches of this court have granted privilege of anticipatory bail to different persons taking note of terms of agreement executed between the
Patna High Court Cr.Misc. No.24640 of 2015 (2) dt.13-07-2015 parties.
Considering the aforesaid facts and circumstances as well as submissions of the parties, in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar in Nawanagar P. S. case no. 52/2015 subject to condition as laid down under section 438(2) of the Cr.P.C.
