JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 21-07-2022 Learned counsel for the petitioner is permitted to remove defect (s), as pointed out by the office, if any, within a period of four weeks on resumption of physical mode. Heard learned counsel for the petitioner and learned APP for the State.

The petitioner has preferred this application for grant of regular bail in a case registered under sections 147, 148, 149, 447 & 120 (B) of the Indian Penal Code and later on Section 302 of I.P.C. was added.

The petitioner and other co-accused persons as well as 6-7 unknown persons armed with weapons in connivance with one another were coming towards the field of the informant and on seeing the accused persons, the informant started to flee

No.16637 of 2022(2) dt.21-07-2022 2/3 away then co-accused, Munshi Marandi and Jetha Marandi inflicted blows of arrow on the chest of the informant's brother, Sanjay Mandal and due to that, Sanjay Mandal got smeared with blood and fell down on the ground. Then the accused persons reached there and assaulted the injured victim severely. Upon seeing this, the informant raised alarm and when he along with other villagers reached there, they saw that the accused persons committed murder of Sanjay Mandal and fled away. Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicated in this case on account of land dispute between the parties. There is general and omnibus allegation of assault against the petitioner. There is specific allegation against the co-accused, Jetha Mandal and Munshi Mandal who inflicted blows of arrows and due to which, Sanjay Mandal succumbed to the injuries. The petitioner has clean antecedent as stated at para 3 of the bail petition. The petitioner is in custody since 27.01.2022.

Learned A.P.P. for the State has opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances and the nature of allegation, the petitioner above-named, is directed

No.16637 of 2022(2) dt.21-07-2022 3/3 to be enlarged on bail on his furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnia in connection with Bhawanipur P.S. Case No. 236 of 2021.

The application stands allowed.
