Petitioner apprehends his arrest in connection with Khagaria P.S. Case No. 744 of 2014 registered for the offence under Sections-406, 420, 471, 468, 467 of the Indian Penal Code. The accusation against petitioner is that he executed an agreement for sale in favour of the informant in the year 2010 but when the sale deed was prepared and produced before the Registrar, the petitioner did not turn up before the Registrar to endorse the registry of the aforesaid sale deed. Learned counsel appearing for the informant submits that petitioner executed a fresh agreement for sale in favour of other person and the aforesaid act of petitioner
Patna High Court Cr.Misc. No.23175 of 2015 (2) dt.14-07-2015 2/2 substantiates this fact that the petitioner had intention to cheat the informant.
In my view, even if, the fact of the present case is taken in toto, then also, the same constitutes a dispute of civil nature.
Accordingly, in the event of his arrest or surrender within four weeks from the date of receipt/production of copy of order in the court below, let the petitioner named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Khagaria P.S. Case No. 744 of 2014 to the satisfaction of Chief Judicial Magistrate, Khagaria subject to conditions as laid down u/S 438(2) of the Cr. P.C.
