Patna High Court CWJC No.8831 of 2021(3) dt.03-01-2022 2/3 Biharsharif in T.S. No.05/2016 by quashing letter no.18 dated 13.01.2021 passed by Assistant Electrical Engineer Electricity Supply Sub-Division no.2, Biharsharif, Nalanda by which Respondent no.6 give illegal and hypothetical bill is being produced by the defendant to harass by way of threatening attitude by giving working for disconnection of electricity line and for reconnection charge (Annexure-9). In spite of petitioner deposited 60% amount of the bill generated by respondent (Annexure-7) in compliance of order dated 30.08.2016 (Annexure-6) passed by the learned Magistrate Biharsharif Nalanda in T.S. No. 05/2016 and after deposit of said amount of punitive bill as per direction, dated 22.02.

2017 new meter has been installed and learned court has been pleased to direct the defendant to raised the electricity bill to the plaintiff on the basis of new meter reading and also directed the plaintiff to deposit electricity bill every month in time and the plaintiff is regularly paying the electricity bill duly consumed of against the new meter installed by the respondent. In spite of the order/direction compiled by petitioner without any latches the defendant issued notice after notice with illegal demand of electricity bill and the petitioner given application to the respondent for correction of the said illegal hypothetical bill (Annexure-9) but the respondent by ignorance generate same illegal bill.

Patna High Court CWJC No.8831 of 2021(3) dt.03-01-2022 3/3 (ii) That the petitioner is not moved any time earlier before this Hon'ble Court to challenge the notice of the Assistant Electrical Engineer Supply Division No.2, Biharsharif, Nalanda letter no.18 dated 13.01.2021.

Learned counsel for the petitioner seeks permission to withdraw the present petition.

Permission granted.

The present petition stands dismissed as withdrawn. Interlocutory application if any shall stand disposed of.
