JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 20-05-2016 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Chakai Police Station Case No. 09 of 2016, disclosing offence under Sections 302/34 of the Indian Penal Code.

The petitioner no. 1 is the father-in-law, petitioner no. 2 is the mother-in-law and petitioner no. 3 is the husband of the deceased.

From the First Information Report, it appears that the marriage between petitioner no. 3 and the deceased had taken place nearly 10-12 years before lodging of the First Information Report. It is submitted on behalf of the petitioner that the police have not collected any material to indicate involvement of these petitioners in

Patna High Court Cr.Misc. No.20548 of 2016 (2) dt.20-05-2016 2/2 the killing of the deceased. According to learned Counsel for the petitioner, the evidence, so far collected, indicates that the deceased committed suicide.

Considering the submission, as above, this application is allowed.

Let the petitioners, namely, Jhari Mian, Belekha Khatoon and Md. Jabbar Ansari @ Jabbar Ansari, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate II, Jamui, in connection with Chakai Police Station Case No. 09 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
