JUSTICE PARTHA SARTHY ORAL ORDER 23-12-2022 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner has preferred this application for grant of regular bail in a case registered under section 380 of the Indian Penal Code.

As per the prosecution case, the informant states that he works at the residence of an officer. He discovered at the date and time mentioned in the FIR that theft had taken place at the house where he works.

It is submitted by learned counsel for the petitioner that the FIR was registered against four unknown. The name of the petitioner transpired in course of investigation on the confessional statement of co-accused. No incriminating article

Patna High Court CR. MISC. No.17340 of 2022(3) dt.23-12-2022 2/2 has been recovered from the petitioner's possession. He has remained in custody since 3.11.2021 and charge sheet has been submitted in the case.

Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the nature of allegation, no incriminating article having been recovered from the petitioner's possession, the material that has transpired in course of investigation together with the petitioner having remained in custody for more than a year since 3.11.2021, the Court directs the petitioner to be enlarged on bail in connection with Shastri Nagar P.S. Case no. 313 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-IV, Patna.
