This application has been filed under Section 482 of Cr.P.C. to quash the order dated 30.07.2012, passed in Complaint Case No. 105 (C) of 2012, whereunder the Court of Judicial Magistrate, 1st Class, Naugachiya, on enquiry, under Section 204 Cr.P.C., summoned the accused petitioners for the offence under Sections 343, 347 and 357/34 of Indian Penal Code. On going through the impugned order, I do not find any illegality amounting to abuse of process of Court for interference in extraordinary jurisdiction under Section 482 Cr.P.C. Accordingly, this application is dismissed. However, the petitioner would be at liberty to raise his defence in the trial court at appropriate stage. (Rajendra Kumar Mishra, J) manish/- U T
