JUSTICE MADHURESH PRASAD ORAL JUDGMENT Date : 08-04-2019 Petitioner has remedy of appeal before the Commissioner, Purnea Division. In view of the availability of remedy by way of appeal, this Court does not consider it appropriate to exercise jurisdiction in favour of the petitioner.

Petitioner's counsel submits that he would be approaching the Appellate Authority i.e., the Commissioner, Purnea Division respondent no. 2 against the order dated 25.06.2014 issued by the District Magistrate, Katihar holding the petitioner guilty of certain charges and awarding the punishment of reduction to a lower scale in the time scale of pay vide order dated 08.03.2013.

The claim of the petitioner would be required to be considered by the respondent no. 2 on its own merit without raising the issue of same being barred by delay. In case the appeal is filed within six weeks, the same should be finally concluded and disposed off by a reasoned and speaking order in accordance with law within eight weeks thereafter.
