The petitioner is in custody in connection with Kotwali (Sadar), Bhagalpur P.S. Case No. 06 of 2019 for the offence under Sections 25 (1-b) (a), 26 and 35 of the Arms Act. Learned counsel appearing on behalf of the petitioner submits that the petitioner has no criminal antecedent. He further submits petitioner and one Neeraj Kumar Singh was apprehended by the police after recovery of country made revolver under their bed. Learned counsel for the petitioner submits that co-accused Neeraj Kumar Singh has been granted bail by Court below and petitioner is in custody since 03.01.2019.

No.19297 of 2019(2) dt.29-03-2019 2/2 Considering the fact that same allegation was levelled against co-accused Neeraj Kumar Singh like the petitioner has been granted bail by the Court below and petitioner has no criminal antecedent, the Court is inclined to enlarge the petitioner on bail. Let, the petitioner named above be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in connection with Kotwali, Bhagalpur P.S. Case No. 06 of 2019.
