The petitioner seeks regular bail in connection with Bela P.S. Case No. 131 of 2017 registered for the offences punishable under Sections 406, 409 and 420 of the Indian Penal Code.
It has been submitted that the petitioner is a Government Teacher, who was entrusted to construct the additional rooms in school campus for which an amount of Rs. 12,00,000/- was sanctioned against the estimated cost of Rs. 15,70,000/-.The petitioner has allegedly performed the work only for an amount of Rs. 4,50,600/-. The learned counsel submits that on account of latches of contractor, the work could not be
Patna High Court Cr.Misc. No.43961 of 2017 (2) dt.21-07-2017 completed in time and the construction work is still going on and is likely to be completed soon. The petitioner is a School Teacher and there is no chance of his absconding. The petitioner is in custody since 10.07.2017.
The learned APP for the State opposed the submission.
Considering the nature of allegation, facts and circumstances of the case, the prayer of bail is allowed. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Bela P.S. Case No. 131 of 2017.
