JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 20-05-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Teghra P.S. Case No.43 of 2016, disclosing offences under Sections 427, 353 and 120B/34 of the Indian Penal Code and Sections 139/140 of the Indian Electricity Act, 2003.

The petitioner is an office bearer of an

Patna High Court Cr.Misc. No.20364 of 2016 (2) dt.20-05-2016 2/3 organization/association of the employees of the North Bihar Power Distribution Company Limited. A call for strike was given and during the period of said call, a Bamboo tree was thrown on 33 K.V. line, causing damage to the underground cable.

From the First Information Report, it appears that the petitioner has been named merely on the basis of possibility that he might have been instrumental in the said occurrence in order to make the strike call a success.

Considering the nature of allegation against the petitioner, contained in the First Information Report, this application is allowed.

Let the petitioner, abovenamed, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Teghra P.S. Case No.43 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the
