This is an application for bail in connection with Sherghati (Dobhi) P.S. Case No. 318 of 2015 registered for the offences punishable under Sections 395, 412 and 414 of the Indian Penal Code.

Petitioner is not named in the FIR and impugned order shows that he has been made accused on the basis of confessional statement.

Submission of learned counsel for the petitioner is that except confessional statement there is nothing against him and he is in custody since 30.12.2016.

Heard learned APP also, who has opposed the prayer for bail stating that petitioner has criminal antecedents. Having heard both sides and in view of confession and

Patna High Court Cr.Misc. No.46518 of 2017 (2) dt.20-09-2017 2/2 petitioner is accused in 21 other cases, at this stage, I am not inclined to grant bail to the petitioner.

However, since the petitioner is in jail for the last nine months, learned trial court is directed to expedite the trial and try to conclude it within a period of nine months. If trial is not concluded within the said period, petitioner may renew his prayer for bail.
