The petitioner seeks bail in Raniganj P. S. Case No. 146 of 2015 instituted for the offence under Section(s) 399, 402, 353, 307, 302 of the Indian Penal Code and Section 27 of the Arms Act .

Learned counsel for petitioner submits that petitioner is in custody since 14.7.2015. Learned counsel further submits that there is no any allegation of specific overt act against this petitioner.

In the written report, it is alleged that police got information that miscreants had assembled for commission of offence on the verandah of school. Police party arrived there then miscreants started making firing in which A.S.I. Praveen

Patna High Court CR. MISC. No.15492 of 2019(2) dt.13-03-2019 2/2 Kumar got injured. A.S.I. Dinesh Prasad Yadav apprehended two miscreants and one person managed to run away. The two apprehended miscreants disclosed their names as this petitioner and Pappu Kumar Yadav. It is further alleged that one loaded country made pistol and one live cartridge has been recovered from possession of this petitioner. The injured police officer was declared dead in the hospital.

Learned counsel for petitioner submits that Pappu Kumar Yadav has already been granted regular bail by coordinate Bench of this Court by order dated 27.6.2018 passed in Cr. Misc. no. 18288 of 2018.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the J.M. 1st Class, Araria, in connection with Raniganj P. S. Case No. 146 of 2015 subject to the condition that both the bailors shall be the close relative of the petitioner.
