JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 02-07-2018 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek pre-arrest bail in connection with Chapra Muffassil P.S. Case No. 50 of 2018 registered under Sections 467, 468, 469, 471, 420, 384, 386, 120(B) read with section 34 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioners that no forged document with respect to the land and houses of Manju Kumari Mishra alias Manju Mishra alleged to have been prepared by the petitioners and others has been produced. There is also a general and omnibus allegation against

Patna High Court Cr.Misc. No.35880 of 2018 (2) dt.02-07-2018 altogether 16 named accused persons including the petitioners who are alleged to have abused the informant and asked for rangdari. There is no evidence whatsoever to support such allegations made by the informant. Moreover, since good senses have prevailed, the parties have amicably settled their dispute and a compromise petition has also been filed in the court below.

Learned counsel for the State opposed the application for grant of pre-arrest bail to the petitioners. Regard being had to the facts and circumstances of the case, in the event of arrest or surrender in the court below within six weeks from today, the petitioners are directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in connection with Chapra Muffasil P.S. Case No. 50 of 2018 subject to the conditions as laid down under Section 438(2) Cr. P.C.
