Petitioner is in custody in connection with Rajiv Nagar P.S. Case No. 111 of 2018 giving rise to Special Case No. 3681 of 2018 for offence under Section 30(a) of Bihar Prohibition Excise Act, 2016.

Learned counsel for the petitioner submits that petitioner is a tenant and the alleged recovery was recovered from the garden of the house where the petitioner is a tenant. He submits that petitioner has no criminal antecedent and he is not the owner of the house from where the alleged liquor was recovered. He further submits that he is in custody since 18.04.2018.

Considering the aforesaid, let the petitioner, above
