2. The petitioner seeks bail in connection with Kudhani P.S. Case No. 457/2023 registered for the offence punishable under Sections 302/120(B)/34 of the Indian Penal Code.

3. The deadbody of the Ashutosh Kumar was discovered. The informant has suspected the hands of the petitioner and others. During investigation, it has come that the deceased Ashutosh Kumar was seen going with Deepak Kumar and Amar Kumar on a motorcycle. Though the CCTV has been examined but the same has not been shown to the victim or any any other co-villager to identify the accused. The petitioner is in

Patna High Court CR. MISC. No.18684 of 2024(3) dt.08-05-2024 2/2 jail since 18.11.2023 and he has clean antecedent.

4. In these circumstances, learned counsel for the petitioner submits that except suspicion, there is no material against the petitioner.

5. Considering the facts and circumstances of the case and also the period of custody, this application is allowed.

6. Let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur/concerned court in connection with Kudhani P.S.
