2. The petitioner seeks regular bail in connection with Barari (Semapur) P.S. Case No. 41 of 2021 registered for the offence under Sections 307, 427, 120(B), 34 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per the prosecution case, the accused persons are said to have fired upon the deceased. Subsequently the petitioner is said to have given final shot at the deceased.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. Petitioner is in custody since 13.02.2023. On instructions, the learned counsel for the petitioner further submits that the charge has been framed on 10.01.2024 and thereafter no witness has

5. Learned A.P.P. for the State has vehemently opposed the prayer for bail.

6. Considering the allegations levelled against the petitioner, I am not inclined to grant regular bail to the petitioner.

7. Accordingly, this application for regular bail stands rejected. If the trial is delayed by the prosecution, the petitioner may renew his prayer for bail.

8. The Superintendent of Police, Katihar is directed to ensure the appearance of the witnesses in the trial on the dates fixed and he will submit a report with regard to the same on the next date of hearing.
