JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-03-2019 The petitioner apprehends his arrest in connection with Basopatti P.S.Case No. 99 of 2018 registered under Sections 302 and 120B/34 of the Indian penal Code.

Allegation against the petitioner is of assaulting the brother of the informant by bricks on his head due to which he succumbed to injury.

Submission of learned counsel for the petitioner is that allegation appears to be false and concocted and several persons have been named in the FIR.

Heard learned APP also.

Having heard both sides and in view of specific allegation of assault against the petitioner, I am not inclined to grant privilege of anticipatory bail to him rather he should surrender within a period of six weeks from the date of receipt of a copy

Patna High Court CR. MISC. No. 15308 of 2019(2) dt.12-03-2019 2/2 of this order and make prayer for regular bail, which shall be considered on its own merit without being prejudiced by this order..
