====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 26-03-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Simri P.S. Case No. 02 of 2019, instituted for the offence under Section(s) 272, 273, 120(B) of the Indian Penal Code, Sections 30(a), 38 and 41 of Bihar Prohibition and Excise Act, 2016.

It is alleged in the written report that petitioner along with four other accused persons as named in the written report were found sitting in the Scorpio vehicle and police recovered 87.840 litres of foreign liquor from the said Scorpio vehicle. It is further alleged that on the disclosure made by the accused persons sitting in the said Scorpio vehicle, one truck was seized which was carrying 1700.64 litres of liquor. The name of driver of the aforesaid truck was Mukesh Kumar.

Patna High Court CR. MISC. No.15906 of 2019(2) dt.26-03-2019 2/2 Counsel for the petitioner submits that co-accused Santosh Kumar with similar allegation has already been granted bail by this Court vide order dated 13.03.2019 passed in Cr. Misc. 15501 of 2019.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. Vth cum Special Judge (Excise), Darbhanga, in connection with Simri P.S. Case No. 02 of 2019, subject to the condition that both the bailors will be the close relatives of the petitioner.
