Heard learned counsel for the petitioner and learned APP for the State.

The petitioner has preferred this application for grant of regular bail in a case registered under Sections 394 and 427 of the Indian Penal Code.

As per the prosecution case, three unknown miscreants intercepted the bus of the informant and attacked on it, thereafter, they broke the side glass of the bus and snatched the gold chain of Mahesh Kumar Jain and also tried to snatch the chain of the informant.

Nothing has been recovered from the possession of the petitioner. The informant is the owner of the said vehicle. The petitioner is also accused in one more criminal case as stated at para 3 of the bail petition. The name of the petitioner is not named in the F.I.R and the name of the petitioner has come on the surface during the course of investigation. The petitioner is in custody since 28.10.2021.

Learned A.P.P. for the State has opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances, the petitioner above-named, is directed to be enlarged on bail on his furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Nawada , in connection with Warisaliganj P.S. Case No. 408 of 2021. This application stands allowed.
