2. The present petition has bee preferred for the following relief/s:

"(i) for commanding the Circle Officer, Sikandra, respondent no.10 to take measurement of Khata no.409, Khesra no. 1315 for construction of

Patna High Court CWJC No.5077 of 2025(4) dt.20-07-2026 2/3 Panchayat Sarkar Bhawan situated at MaujaGokula, Fatehpur, Gram Panchayat-Gokula which has been approved by the competent authority pursuant thereto tender has been finalized.

(ii) also for necessary relief reliefs, order/orders, direction/directions for which the petitioners are entitled in the eye of law."

3. With the consent of the parties, both the CWJC No. 5077 of 2025 and I.A. No. 01 of 2025 are taken up together.

4. The matter relates to construction of Panchayat Bhawan and the Collector, Jamui has clarified that earlier the land coincided with the piece of land earmarked for canal construction under Kundghat Jalashay Yojana, and thus, the respondent deemed it proper to shift the Panchayat Bhawan site to Khata No. 409, Plot No. 517 in which the Panchayat Sarkar Bhawan has already started.

This Court is of the view that the Collector of the district has come out with a valid point/reason for shifting the construction of the Panchayat Bhawan from plot no. 1315 to plot no. 517 and there is no rebuttal. Copy of counter-affidavit has been served upon the office of the learned counsel for the petitioner.

6. A Panchayat Bhawan is being constructed which will benefit the locals, the decision to construct it on a particular

Patna High Court CWJC No.5077 of 2025(4) dt.20-07-2026 3/3 place has been taken by the respondents, the record shows that the work has already commenced, in that background, this Court is of the view that there is no reason to put any spoke in the wheel.

7. With the aforesaid observation, the writ petition as also I.A. No. 01 of 2025 stand disposed of.
