JUSTICE AHSANUDDIN AMANULLAH ORAL JUDGMENT Date: 06-02-2017 Nobody appears on behalf of the petitioner. Learned counsel for the State has assisted the Court. The petitioner has moved the Court for a direction to the respondents to implement the order of the Senior Superintendent of Police, Patna by which the respondent no. 6 was directed to pay a sum of Rs. 2,500/- per month to the petitioner. The petitioner is the wife of Late Constable Shibjee Thakur, who died in harness and because the children of the deceased were minors, the petitioner agreed to the appointment of the respondent no. 6, who was the brother of the deceased on compassionate ground. As the same was made on the condition that
Patna High Court CWJC No.12435 of 2014 dt.06-02-2017 2/2 he would support the family of the petitioner, when it was not being complied with, she had moved before the Authority and thus, a direction came to be issued by the Senior Superintendent of Police, Patna directing the respondent no. 6 to pay Rs. 2,500/- per month to the petitioner. Due to non payment of the same, the petitioner has filed the present writ application.
Learned counsel for the State submitted that on the basis of instructions received, the order has been complied with and the arrears of Rs. 47,500/- have been paid to the petitioner and further the respondent no. 6 has also undertaken to pay the amount regularly to her.
In view of the aforesaid and the fact that nobody appears on behalf of the petitioner, the Court can only presume that the grievance of the petitioner stands redressed. Accordingly, the writ application stands disposed off. However, if in future the occasion arises where the petitioner is not paid the due amount, she shall be at liberty to approach the Court or the appropriate authority again. (Ahsanuddin Amanullah, J.)
