JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 12-06-2018 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner, in the present case, is seeking regular bail in connection with Bairgania P.S. Case No.134 of 2017 registered for offences alleged under Sections 272 and 273 of the Indian Penal Code and Section 30(A) of Bihar Prohibition and Excise Act, 2016.

It is submitted on behalf of the petitioner that the petitioner has falsely been implicated by the police in course of investigation. Learned counsel points out that earlier when the F.I.R. was lodged, the father of this petitioner and driver of the tempo were made accused. The father of the petitioner was arrested and remained in custody for about two and half months in

Patna High Court Cr.Misc. No.33918 of 2018 (2) dt.12-06-2018 connection with this case, later on petitioner has also been involved. The total recovery is that of 162 liters of illicit liquor from the vehicle in question which is owned by the father of the petitioner.

Learned A.P.P. for the State is present.

Considering the facts and circumstances of the case where this petitioner is said to have no criminal antecedent and the vehicle in question is owned by the father of the petitioner who was earlier arrested in connection with this case, let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi, in connection with Bairgania P.S. Case No. 134 of 2017, subject to the conditions under Section 437(3) Cr.P.C. (Rajeev Ranjan Prasad, J) Arvind/- U T
