Petitioner is apprehending his arrest in Basantpur P.S. Case no. 340 of 2014 registered under section 304(B) of the Indian Penal Code.
Prosecution case in short is that Bihari Ram gave his fardbeyan on 15.11.2014 before the officer-in-charge Basantpur Police Station that his daughter has sustained burn injury. He and his nephew went to the house of the husband of his daughter at Narharpur village. He Saw that his daughter was crying due to burn injury. He asked his nephew to go to police station. His nephew went o his village, took the mother of the deceased and then went to Basantpur Police Station. The police went to the place of occurrence, talked to his daughter and brought her to hospital at Basantpur. The doctor referred her to Sadar Hospital, Siwan for better treatment. It has been submitted on behalf of the petitioner that petitioner has no criminal antecedent. It is further submitted that the petitioner is father-in-law of the deceased and he is living separately from the husband of the deceased and he has nothing to do in the family affairs of the husband of the deceased.
It has been submitted on behalf of the State that the petitioner is named in the first information report. Considering the facts and circumstances of the case, the above named petitioner in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in Basantpur P.S. Case no. 340 of 2014, subject to the conditions as laid down under section 438(2) Cr.P.C.
