The petitioner seeks regular bail in Kishanganj Mahila P.S. Case No.50 of 2016 registered for the offence under Sections 372,373,34 of the I.P.C. and Sections 3, 4 and 5 of Immoral Traffic Act.
Allegation against the petitioner is that once she told the mother of the informant to get her daughter married with a boy thereafter the petitioner called the informant (victim) to purchase saree and blouse of her own choice in the market because the boy had come. But the victim in course of giving blouse to tailor she smock
some foul play due to which she brought them to her house and upon query about the boy the petitioner could not reply satisfactorily due to which the mother of the informant raised suspicion then the boy fled away on commotion and the petitioner along with another lady, co-accused was caught with the help of the villagers.Both persons are said to be engaged in immoral trafficking. Submission of the learned counsel for the petitioner is that she has been implicated only on the basis of suspicion and she is in custody for eight months. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of the C.J.M., Kishanganj, in Kishanganj Mahila P.S. Case No.50 of 2016 subject to the conditions that (1) one of the bailors of the petitioner shall be a local person having sufficient immovable property
within the jurisdiction of the concerned court. (2) The petitioner will not induce any witness or tamper with the evidence. (3) The petitioner shall co-operate in disposal of trial and make himself available as and when required by the court. In the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reason, his bail bond shall be cancelled.
