The petitioner is in custody in connection with Jamhore P.S. Case No. 23 of 2018 for the offence under Sections 30 (a), 38 (I) of Bihar Prohibition Excise Act. Learned counsel for the petitioner submits that petitioner has no criminal antecedent. Petitioner is in custody since 26.02.2018. He further submits that similarly circumstanced other co-accused Md. Mahtab Alam was granted bail by the co-ordinate Bench of this Court, vide order dated 08.05.2018 in Cr.MISC. No. 28206 of 2018.

Considering the fact that the petitioner has no criminal antecedent and has remained in custody for nearly three and half months, coupled with the fact that the co-accused has been

Case No. 23 of 2018.
