The petitioner apprehends his arrest in Rahika P.S. case No. 15 of 2016 under Section 379/34 of the Indian Penal Code.

The informant alleged that while he was returning with his friend, three persons came on a motor cycle and forcibly snatched his mobile of S.P.C. company. The informant chased the miscreants and on chase one Rishu Kumar was apprehended. Two other accused persons managed to flee away. Rishu Kumar disclosed the name of petitioner, Raju Kumar Sahu, as his one of the accomplice.

The learned counsel for the petitioner submits that petitioner is a student of Mithila University and save and except

No.18784 of 2016 (3) dt.18-07-2016 2/2 confession of co-accused, Rishu Kumar, there is no material to show the involvement of the petitioner but it appears that name of the petitioner figured in the case in the statement of none else than the co-accused Rishu Kumar, who was apprehended on being chase. Hence, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Jha, J) BKS/- U T
