The petitioner is languishing in custody since 07.02.2019 in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. It is alleged that on the basis of secret information checking of vehicles was conducted and from a Wagon-R car, 136 litres of illicit indian made liquors were recovered in which three persons including the petitioner were found travelling. It is submitted by learned counsel for the petitioner that the petitioner was simply a passenger in the said car and he has no concern with the alleged car or the recovered liquor. Learned APP submits that the recovery has been made from a car in which the petitioner was found travelling. Considering the fact that the recovery has been from a car in which three persons including the petitioner were found travelling, coupled with the statement made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 6th Additional Sessions Judge cum Special Judge, Biharsharif, Nalanda in connection with Case No. 14C3 (Excise) of 2019.
