The petitioner seeks bail in Madanpur P.S. Case No. 138/2014, registered for the offences punishable under Sections 147, 148,149, 353, 435 and 427 of the Indian Penal Code as well as Section 27 of the Arms Act and 3⁄4 Explosive Substance Act and 17 C.L.A. Act.

The case of the prosecution, in short, is that on 18.07.2014 a huge mob of about 500 persons attacked and ransacked government establishments of Madanpur and resorted to brick batting, resulting in damage of public property. Learned counsel for the petitioner submits that the petitioner was arrested in connection with Aurangabad (Town) P.S. Case No. 147/2017 and only thereafter he has been remanded in the present case, though, there is no material on record to

It is further submitted that there is no specific allegation of any brick batting against the petitioner. Having regard to the facts and circumstances of the case, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Madanpur P.S. Case No. 138/2014.
