The petitioner, already in custody, seeks bail in connection with Kishanganj P.S.Case No. 204 of 2018 registered under Sections 413 and 414 of the Indian penal Code. Allegation in brief is that petitioner along with one pillion rider was taking away aluminum wire about 200 metres in length suspected to be stolen one.

Submission is that wire was not stolen one, there is no allegation that theft has been committed and petitioner bears clean antecedent and has been in custody since 21.03.2018. Having considered the aforesaid facts and circumstances, the petitioner, namely, Md. Shahid Akhtar @ Shahid Akhtar, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the
