Petitioners apprehend their arrest in a case registered for the offence punishable under Section 363, 366A/34 of the Indian Penal Code.
Allegation against the petitioners is to have kidnapped the minor daughter of the informant on the strength of pistol.
It has been submitted on behalf of the petitioners
Patna High Court CR. MISC. No.33083 of 2021(2) dt.26-10-2021 2/3 that they are innocent and have falsely been implicated in this case due to enmity and village politics. It is further submitted that petitioners, who happen to be father, mother and brothers of the accused, Chhotu Kumar Ray, who is said to have love affair with daughter of the informant. It is further contended that the victim girl and Chhotu Kumar Ray were in love with each other and they solemnized marriage at Shri Shiv Mandir Khudneshwar Dham Nyas Committee Morwa, Samastipur on 25.11.2020 against the wishes of their parents and same is evident from perusal of marriage certificate issued by the said Mandir, as contained in Annexure 2/A and 2 /B. It is further contended that daughter of the informant herself affidavited before Notary Public Samastipur on 26.11.2020 that she is major of 19 years girl and has married with Chhotu Kumar with Hindu rites and customs. Petitioners have no criminal antecedent.
Considering the aforesaid facts and circumstances of the case, let the petitioners named above be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bond of Rs. 20,000/- each with two sureties of the like amount each to the satisfaction of learned court below where the case is
Patna High Court CR. MISC. No.33083 of 2021(2) dt.26-10-2021 3/3 pending in connection with Dalsing Sarai P.S. Case No.354 of 2020 subject to the condition as laid down under Section 438(2) of the Cr.P.C.
