The petitioner is languishing in custody since 30.12.2018 in a case registered for the offences punishable under Sections 272 and 273 of the I.P.C. and Section 41(i) of the Bihar Prohibition and Excise Act, 2016.
The prosecution case is that two persons were apprehended by the police who disclosed their names as Nagendra Ram (petitioner) and co-accused Munna Kumar. It is alleged that altogether 14 litres of Indian made foreign liquor were recovered, out of which, 8.640 litres were recovered from the possession of the petitioner.
Patna High Court CR. MISC. No.16201 of 2019(2) dt.15-03-2019 2/2 Learned APP submits that the recovery has been made from the petitioner.
Considering the quantity of recovery and the period under custody, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II-cum-Special Judge, Excise, Siwan in connection with Mahrajganj P.S. Case No.329 of 2018.
Since the petitioner is having serious criminal antecedent, the learned Court below will be at liberty to cancel the bail bonds of the petitioner in case he defaults on three consecutive occasions.
