Heard learned counsel for the petitioner and learned counsel for the State The petitioner is apprehending his arrest in connection with Kankarbagh P.S. Case No. 712 of 2014 for the offences instituted under Sections 498(A), 363, 365/34 of the IPC and 3⁄4 of the D. P. Act.
The prosecution story, in brief, is that on 25.12.2014 at about 11 O'clock Ranjit Mishra the husband of Mamta gave telephonic information to the informant that Mamta is missing. So
Patna High Court Cr.Misc. No.23491 of 2015 (4) dt.21-09-2015 2/3 the informant requested the petitioner to search her. According to the informant, Mamta was married with Ranjit Mishra on 29.02.2009 and she went to her Sasural and came back to her maike on 04.07.2009. According to the informant, Ranjit Mishra and his father demanded Rs. 3 Lakh and a four wheeler vehicle in dowry and due to non-fulfilment of demand they caused cruelty with her sister. Accordingly to the informant, on 30.11.2014 Mamta Devi went to her Sasural on Duragman. The informant went to meet to her sister then she stated that Sachindra Mishra and his son assaulted her.
It has been submitted on behalf of the petitioner that the petitioner has falsely been implicated in the present case. It has further been submitted that prior to institution of the present case, informatory petitions were filed vide Annexures-4 and 5 by the petitioner and the father of the petitioner. From perusal of Annexures- 2 and 3 to the main bail petition and 7 to the supplementary affidavit, it is evident that the victim was in love affair with some other boy prior to marriage. In the case diary also the Supervising Officer has stated that due to the said love affair the victim has left her in-laws family.
On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Patna High Court Cr.Misc. No.23491 of 2015 (4) dt.21-09-2015 3/3 Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of four weeks from today in connection with Kankarbagh P.S. Case No. 712 of 2014 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Patna, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
