This application is for grant of regular bail in connection with Tarapur (University) P.S.Case no.91 of 2017, for the offences punishable under Section 307 of the Indian Penal Code.

Allegation against the petitioner is of pointing Pistol on the informant and try to assault him. There is also a case of recovery of one Pistol from the possession of the petitioner. Submission of the learned counsel for the petitioner is that for the recovery of Pistol, another case has been filed against him and there is no allegation of assault against the petitioner and he is a student.

Heard learned A.P.P. also, who has opposed the

Patna High Court Cr.Misc. No.40335 of 2017 (2) dt.25-08-2017 2/2 prayer for bail.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage, however, this application is disposed of with direction to the learned court below that once the chargesheet is submitted against the petitioner in this case, he will verify the facts as to whether there are antecedents of the petitioner and if there is no other case against him except the aforesaid one and there is also no allegation of assault against him except pointing Pistol on the informant, he will release the petitioner in connection Tarapur (University) P.S.Case No.91 of 2017 to the satisfaction of A.C.J.M. 7th, Bhagalpur.

With the aforesaid observation, this application is disposed of.
